Introduction

These Terms of Service ("Terms") govern your use of Workforce AI's platform ("the Platform"), which is developed and operated by AI Connect Hub Pty Ltd trading as Workforce AI (ABN: 89 681 471 876). By accessing or using the Platform, including the website, software, web-based and mobile application, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

Definitions

  • "Platform" refers to the Workforce AI software and its associated website, web and mobile application.
  • "User," "you," or "your" refers to any person or entity who accesses or uses the Platform.
  • "Company," "we," "our," or "us" refers to AI Connect Hub Pty Ltd trading as Workforce AI.
  • "Customer Data" refers to the data input or uploaded by users to the Platform.
  • Eligibility and Account Registration

    To use the Platform, you must:

  • Be at least 18 years old or the age of legal majority in your jurisdiction.
  • Provide accurate and complete information during the account registration process.
  • Maintain the confidentiality of your login credentials and be responsible for all activities under your account.
  • Ensure that your use of the Platform complies with all applicable laws in Australia, New Zealand and other relevant jurisdictions.
  • User Obligations

    By using the Platform, you agree that:

  • You will only use the Platform for lawful purposes and in accordance with these Terms.
  • You will not misuse or interfere with the security or operation of the Platform.
  • You will not use the Platform to infringe the intellectual property rights of others.
  • You are responsible for the accuracy and legality of any Customer Data you input or upload to the Platform.
  • You will not use the Platform to collect personal information from others without their consent or in violation of applicable laws.
  • Services Provided by the Platform

    The Platform provides a range of business management tools powered by Artificial Intelligence (AI) large language models, including but not limited to:


  • Health AI Assistant: Assists with medical scribing, voice-to-text transcription and document/note generation.
  • Phone AI Assistant: Handles inbound and outbound calls, performs receptionist tasks and provides call transcription services.
  • Marketing AI Assistant: Automates social media and digital marketing tasks, including campaign management and analytics.

  • Services may be updated or modified from time to time without prior notice. We do not guarantee that the Platform will be error-free, uninterrupted or available at all times. We reserve the right to modify, suspend or discontinue any feature or part of the Platform without notice.

    AI Disclaimer

    The AI-generated content provided by the Platform is intended to assist users in their professional workflows. It is not a substitute for professional judgment, advice or decision-making.

  • Users are solely responsible for verifying the accuracy and appropriateness of AI-generated content before relying on it.
  • Workforce AI does not guarantee the accuracy, reliability or completeness of AI-generated content and disclaims all liability arising from its use.
  • Data Ownership and Rights

  • You retain ownership of any data you upload to the Platform ("Customer Data"). By uploading Customer Data, you grant us the right to use it for the purpose of providing and improving the services.
  • We do not share or sell Customer Data to third parties, except as required by law or as specified in our Privacy Policy.
  • We may use de-identified data for analytics and functionality improvements, ensuring that it cannot be re-identified.
  • Payment Terms

    The Platform operates on a subscription-based model, with additional charges for third-party services, service add-ons and "Done For You" services.

  • All payments, including subscription fees, third-party service fees and charges for "Done For You" services are non-refundable unless otherwise required by law.
  • Subscription fees are billed in advance and are subject to change with prior notice.
  • Refund Policy

  • If Workforce AI terminates your access to the Platform for reasons other than a breach of these Terms, you will be entitled to a pro-rata refund of any unused subscription fees.
  • Refunds are not available for user-initiated cancellations.
  • Confidentiality

  • Workforce AI will take all reasonable steps to protect confidential information from unauthorized access or disclosure.
  • Access to confidential information will be limited to employees and contractors who require it to provide the Platform's services.
  • Security and Two-Factor Authentication (2FA)

    Workforce AI supports two-factor authentication (2FA) to enhance account security. Users are encouraged to enable 2FA to protect their accounts from unauthorized access.

    Termination and Data Deletion

  • We may suspend or terminate your access to the Platform at any time if you violate these Terms, engage in fraudulent or illegal activities or fail to pay fees owed to us.
  • Upon termination, your access to the Platform will be immediately revoked and we will delete or anonymize your data within 30 days, except where retention is required by law.
  • Force Majeure

    Workforce AI shall not be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, acts of government, or technical failures.

    Third-Party Integrations

    The Platform may include third-party integrations to enhance functionality. Users agree to comply with any additional terms associated with these integrations.

    Limitation of Liability

    To the maximum extent permitted by law, AI Connect Hub Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, business interruption, loss of data, or reputational harm arising out of your use or inability to use the Platform.


    Our liability under these Terms is limited to the amount you have paid for the use of the Platform within the twelve months preceding the incident that gave rise to the claim.

    Governing Law and Dispute Resolution

    These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from or related to these Terms shall be resolved in the courts of New South Wales, Australia.

    Privacy & Data Use

    Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, use and protect your personal information. By using the Platform, you agree to the terms of our Privacy Policy.

    Privacy obligations

  • Each party must, in the performance of these Terms, comply with applicable privacy laws in respect of any personal information, including without limitation the Privacy Act 1988 (Cth) in Australia, and any other relevant jurisdictional privacy laws.
  • Without limiting clause 1(a), you must ensure that at all times you hold all necessary authorisations and current consents from individuals (including patients) to disclose their personal information (including sensitive information) to Workforce AI, so that Workforce AI may collect, use, store and disclose personal information (including sensitive information) for the purpose of operating Workforce AI and as described in our Privacy Policy, without you or Workforce AI infringing any law or the rights (including the intellectual property rights, moral rights or privacy rights) of any individual.
  • Personal Information Collection Notice

    We collect, store, use and disclose personal information about you and your customers in order to provide you with use of Workforce AI and for purposes otherwise set out in our Privacy Policy.

    Modifications to the Terms

    We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
